These Terms of Use (“Terms”) govern your access to and use of https://www.dialnsearch.com/ (the “Site”) and any corporate, technology or partnership enquiry submitted through the Site or related contact channels referenced here.

The Site is operated by Dial N Search Private Limited (“Dial N Search”, “we”, “us”, “our”), incorporated in India on 22 December 2009 (CIN U72300MH2009PTC353199, GSTIN 27AADCC8227F1ZQ). By accessing the Site or sending an enquiry, you agree to these Terms. If you do not agree, do not use the Site.

These Terms are for the corporate Site aimed at organisations and technology buyers. They are not the creator / brand-campaign terms published on dialnsearch.co.in. Please also read our Privacy Policy and Disclaimer.

1. Definitions

  • “Site” means https://www.dialnsearch.com/ and pages under that domain that present corporate, technology and contact information.
  • “Products” means software and related offerings of Dial N Search Private Limited referred to on the Site, including Sales Funda®, SF Astra, FQRS and SF Prep, as described further on their respective product domains where applicable.
  • “Sister sites” means related properties operated for distinct audiences or initiatives, including the creator / promotions site at dialnsearch.co.in and any healthcare-related PhysioKare properties referenced for ecosystem clarity (PhysioKare is not Dial N Search software).
  • “Services” means professional, implementation, support or other work we may provide after discussion under a separate written agreement — not merely browsing the Site or submitting an enquiry.

2. About the Site

The Site explains who Dial N Search Private Limited is, outlines our technology map and invites corporate contact. Typical content includes:

  • company identity, offices and diligence facts (see Corporate);
  • high-level descriptions of Products and how they relate to each other;
  • historical project context (for example ISOMED-BARC, BRIT-BARC, TMS-BARC) described for background only;
  • pointers to Sister sites and product domains for deeper product or creator topics.

The Site is informational and enquiry-oriented. Content on the Site does not by itself create a paid licence, statement of work, partnership, employment relationship or exclusivity.

3. Eligibility

You must be legally capable of entering into a binding agreement under applicable Indian law. If you use the Site on behalf of a company or other organisation, you confirm you are authorised to bind that organisation to these Terms for Site use and to submit enquiries on its behalf.

4. Enquiries are not automatic contracts

Submitting a form, email, phone call or WhatsApp message is a request for contact. We may accept, decline, ignore spam or propose different terms. Commercial terms — licence fees, scope, deliverables, timelines, SLAs, data processing, warranties and payment — are agreed separately in writing (email may be sufficient for operational confirmations as described in Section 10, unless we specify a signed agreement). A demo, brochure download or Site visit does not create an obligation to purchase.

5. Product references & separate product terms

References on the Site to Products are for orientation. Authoritative feature lists, pricing (if any), service descriptions and end-user or SaaS terms appear on the relevant product domains and in written agreements, including:

  • Sales Funda® — salesfundaa.com;
  • FQRS — fqrs.co.in;
  • SF Astra and SF Prep — as described on the Site and in materials we provide in writing for those offerings.

Use of a Product is subject to that Product’s terms, order forms and any master agreement between you and Dial N Search — not to these Site Terms alone. We do not invent or publish brand-campaign, creator-payout or live-app agency terms on dialnsearch.com; those topics belong on dialnsearch.co.in where applicable.

6. Acceptable use

You agree not to:

  • use the Site for unlawful, harmful, fraudulent or misleading activity;
  • attempt to gain unauthorised access to servers, accounts, APIs or data;
  • scrape, harvest or bulk-copy Site content or enquiry endpoints without our written permission;
  • upload malware or interfere with Site operation;
  • impersonate another person or misrepresent affiliation with Dial N Search or our Products;
  • submit spam, deceptive vendor pitches or abusive content through enquiry channels.

We may suspend access or ignore abusive enquiries.

7. Intellectual property

Unless otherwise stated, the Site’s design, text, graphics, logos and arrangement are owned by Dial N Search Private Limited or used under licence. You may view pages for personal or internal business evaluation. You may not copy, republish, sell or create derivative works from Site content without prior written consent, except as allowed by mandatory law (for example limited quotation for commentary or fair dealing).

Sales Funda® is a registered product brand of Dial N Search Private Limited. Other Product names (including SF Astra, FQRS and SF Prep) and the Dial N Search name are used to identify our company and offerings. Third-party names and marks on the Site belong to their respective owners and are mentioned for identification only. Historical project labels (ISOMED-BARC, BRIT-BARC, TMS-BARC) are descriptive references and do not transfer any rights to you.

8. Privacy

Personal information submitted through the Site is handled as described in our Privacy Policy, which forms part of your understanding when you use the Site.

9. Commercial terms

Fees, licence models, statements of work, professional services rates, payment schedules, taxes (including GST where applicable) and renewals apply only when set out in a written commercial agreement, quotation accepted in writing, or order form between Dial N Search and the contracting party. Nothing on the Site constitutes a standing offer at a fixed price. These Terms do not cover creator payments, influencer commissions or live-app wallet settlements; those subjects are outside the scope of this corporate Site.

10. Electronic communications & email confirmations

Unless a specific document must be executed in a particular form under applicable Indian law, Dial N Search may treat written confirmations sent by email (or other agreed electronic means) as binding for operational and commercial purposes in a B2B relationship — only when sent from the same registered / official email recorded for that party.

Same email = authenticity. Confirmations should come from:

  • the email address mentioned in our written contract, quotation or confirmation with that organisation; or
  • the official company email of Dial N Search that we use for that matter (for example info@dialnsearch.com or another address we specify in writing); or
  • the counterparty’s registered official email already on our records for that relationship.

A message from any random or new email that is not on record for that contract or relationship will not normally be treated as valid approval, change order, acceptance or waiver. Using the same registered email helps establish authenticity of the sender.

Where the reply from that registered email is clear — for example “yes”, “approved”, “confirmed” or “we agree” — it may cover operational approvals, scope acknowledgements and similar B2B confirmations. A separately signed paper contract is not always required for every such confirmation, though we may still require a signed or e-signed agreement for licences, high-value work or sensitive matters. Ambiguous or incomplete replies may not be treated as acceptance.

Legal reference (India): Contracts and acceptances formed through electronic means are recognised under Section 10A of the Information Technology Act, 2000 (validity of contracts formed through electronic means), read with the Indian Contract Act, 1872. Electronic records may also be relied on as evidence where permitted under applicable evidence law, including the regime formerly under the Indian Evidence Act, 1872 (including provisions relating to electronic records such as Section 65B, as applicable to the proceeding) and, where applicable, the Bharatiya Sakshya Adhiniyam, 2023 (including provisions on electronic / digital records such as Section 63). Court proof may require prescribed certificates or other formalities — this Site does not waive those requirements.

11. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIAL N SEARCH PRIVATE LIMITED AND ITS DIRECTORS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SITE OR RELIANCE ON ITS CONTENT.

FOR PAID PRODUCTS OR SERVICES, LIABILITY (IF ANY) WILL BE GOVERNED BY THE SPECIFIC WRITTEN AGREEMENT FOR THAT ENGAGEMENT AND MAY BE CAPPED AT FEES PAID FOR THE RELEVANT SERVICE PERIOD, EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER LAW (FOR EXAMPLE FRAUD OR WILFUL MISCONDUCT).

13. Indemnity

You agree to indemnify and hold harmless Dial N Search Private Limited from claims, losses and expenses (including reasonable legal fees) arising from your misuse of the Site, your breach of these Terms, materials you submit through enquiry channels, or your violation of third-party rights or applicable law in connection with Site use.

14. Links

Outbound links — including to product domains, Sister sites, maps and third-party resources — are provided for convenience. We are not responsible for third-party sites, their availability, or their terms and privacy practices.

15. Changes

We may modify Site content or these Terms at any time. Updates will show a new “Last updated” date. Continued use after changes means you accept the revised Terms. If you do not agree, stop using the Site.

16. Termination

We may stop offering the Site or refuse to process abusive or unlawful enquiries. Provisions that by nature should survive (intellectual property, disclaimers, limitation of liability, indemnity, governing law) will survive.

17. Governing law & disputes

These Terms are governed by the laws of India. Subject to mandatory rules, courts in Maharashtra, India shall have exclusive jurisdiction over disputes arising from these Terms or the Site.
